Terms of service

These terms cover your use of Classivo. They are written to be read, and where a clause exists for a reason that is not obvious, we say what the reason is.

1. Who these terms are with

Classivo is provided by Classivo ("we", "us"). "You" means the organization that opens an account — usually a learning center. If you are accepting these terms, you are confirming you are allowed to do so on that organization's behalf. You accept them by ticking the box when you create your account.

2. What you are buying

A subscription to the platform, plus whichever add-ons you enable. Add-ons are charged separately and each works without the others, with one exception: the Language Pack translates the forms you make with Document Organizer, so it needs that add-on. There are no plan tiers, so no feature is withheld to make a larger plan more attractive.

We may add, improve or retire features. If we retire something you are actively paying for, we will give you 60 days' notice and you may cancel that add-on without penalty.

3. Fees and billing

  • Fees are those published at /pricing when you subscribe, in US dollars.
  • Billing is monthly in advance. An add-on enabled part-way through a period is charged pro rata for the remainder of that period, then at the full rate from the next renewal.
  • Prices are flat for your organization. They never depend on the number of users, staff, seats or students.
  • If we ever introduce usage-based charges — text messaging is the only planned case — the allowance and the overage rate will be published before you can enable it.
  • We will give you 60 days' notice before changing the price of anything you already subscribe to.
  • Our order process is conducted by our online reseller Paddle.com, which is the merchant of record for all orders. Paddle handles payment, invoicing, sales tax and refunds. See the refund policy.

4. Cancelling

You can turn off any add-on, or close your account, at any time. Cancellation takes effect at the end of the period you have paid for. We do not charge a cancellation fee and we do not require you to speak to anyone first.

Separately from cancelling, every payment is refundable in full for 30 days after it is taken, with no conditions attached — the refund policy sets this out in full.

For 30 days after you close an account, you can still export your data. After that we delete it, as described in the data processing addendum.

5. Your data is yours

Everything you and your parents put into Classivo belongs to you. We do not claim ownership of it, we do not sell it, we do not use it to advertise, and we do not use it to train machine-learning models. We process it to run the service for you and for nothing else.

6. Your responsibilities

  • Give accurate account information and keep it current.
  • Keep credentials secure, and remove staff accounts when people leave.
  • Have a lawful basis for the personal data you collect from families, and tell them what you are collecting. The forms are yours; the relationship with the parent is yours.
  • Do not use the service to send unsolicited bulk mail, or to break the law.
  • Do not attempt to access another customer's data, or to probe the service for vulnerabilities without asking us first. If you find one, tell us — see section 11.

7. Email sending

Mail to parents is sent through your own email account, which means your provider's sending limits and acceptable-use rules apply, not ours. We are not responsible for mail your provider refuses, delays or filters, and we cannot raise a limit that is not ours to raise. We will show you the delivery result we get for every recipient.

8. Service levels and support

We aim for the service to be available at all times and will publish planned maintenance in advance. We do not offer a contractual uptime guarantee or service credits, and we would rather say so than publish a number we cannot stand behind: this is a small team and an honest "no formal SLA" is worth more to you than a promise with no engineering behind it. If an outage costs you a period of service, tell us and we will credit it.

Support is by email at support@classivo.co, Monday to Friday, with a target first response within one business day. Billing questions go to billing@classivo.co.

9. Service work

Custom form builds, onboarding, migration and branding are quoted separately and are not part of the subscription. Each engagement is agreed in writing before work starts. What we build for you is yours to use for as long as you are a customer. The content you supply — your questions, your wording, your policies — stays yours outright. The underlying templates and components we build on stay ours, and we may reuse them for other customers; we will not reuse your content, your branding, or anything specific to how your center operates.

10. Liability

Our total liability to you for any claim connected with the service is limited to the fees you paid us in the twelve months before the claim arose. Neither side is liable to the other for indirect or consequential loss, or for lost profits, revenue, goodwill or anticipated savings.

Nothing in these terms limits liability for anything that cannot lawfully be limited.

11. Security reporting

If you believe you have found a security problem, tell us through the contact form with enough detail for us to reproduce it. We will not pursue you for a good-faith report made under these conditions: you do not access data belonging to anyone else, you do not degrade the service, and you give us reasonable time to fix it before telling anyone else.

12. Suspension

We may suspend an account for non-payment after 14 days, and only after we have written to warn you, or immediately if it is being used to attack the service or others. We will restore access as soon as the cause is resolved, and we will not delete your data during a payment suspension.

13. Governing law

These terms are governed by the laws of the country in which we are established. Nothing here removes a right you have under the consumer or data-protection law of the country you are in, and nothing here prevents either of us from bringing a claim in the courts of that country where the law gives us that right. Your purchase itself is made from Paddle.com as merchant of record and is governed by the Paddle buyer terms.

14. Changes to these terms

We will tell existing customers by email before material changes take effect, at least 30 days in advance. Continuing to use the service after that means you accept the new terms; if you would rather not, cancel and we will refund the unused part of your current period.

15. Emails from us

When you create an account you agree that we may email you about Classivo itself: product news, new features and offers. That is separate from the messages we have to send to run your account — sign-in links, receipts, and security or service notices — which you will receive for as long as you have an account.

The news and offers are the optional part. Every one carries an unsubscribe link, and when you use it we stop sending them. Unsubscribing does not close your account or change the service in any way.

We never use the families' details you keep in Classivo to market to them. That data is yours (section 5), and these emails go only to you.
